September 2, 2009

Fried, Frank, Harris, Shriver & Jacobson LLP announced today that Bernard "Barry" Nigro will return to the Firm as a partner in the Antitrust Department resident in Washington, DC. Mr. Nigro was previously a partner at Fried Frank from 1999 to 2003. From 2003 to 2005, Mr. Nigro served as the Deputy Director for the Federal Trade Commission's Bureau of Competition, where he supervised merger and non-merger enforcement divisions and developed agency policies related to compliance, merger and non-merger matters, and pre-merger notification. During his tenure at the Federal Trade Commission, Mr. Nigro oversaw numerous merger investigations and litigations across a broad range of industries, including pharmaceuticals, defense, energy, music, tobacco, consumer products, and aerospace. Immediately prior to rejoining Fried Frank, Mr. Nigro was an antitrust partner at Willkie Farr & Gallagher LLP in their Washington, DC office.

"We are very pleased to welcome Barry back to Fried Frank. He is an extremely experienced and highly regarded antitrust practitioner with a strong background of both private and government service," said Valerie Ford Jacob, Fried Frank's Chairperson.

Mr. Nigro's practice focuses on civil and criminal matters under federal and state antitrust laws and he frequently appears before the Federal Trade Commission, the Antitrust Division of the Department of Justice and state attorney general offices. As part of Fried Frank's Antitrust Department, Mr. Nigro will represent major US and international corporations on antitrust matters in connection with mergers and acquisitions, internal investigations, litigations, and counseling.

"Antitrust and competition issues are integral to the broad range of corporate clients Fried Frank represents," said Justin Spendlove, Fried Frank's Managing Partner. "Barry's extensive experience in high-stakes transactions and complex litigation adds strength to an already strong team of first-rate antitrust lawyers at the Firm."

Robert Schwenkel, chair of Fried Frank's New York corporate department and head of the Firm's M&A and private equity practices added, "Barry has extensive experience securing merger approvals critical for the size and complexity of deals our preeminent M&A and private equity practices have been known to handle for more than three decades. With enhanced antitrust capability we can deliver more for our clients and help them to achieve their business goals."

Mr. Nigro currently serves as an officer on the Council of the ABA's Section of Antitrust Law and previously served as the Chair of the organization's Communications Industry and Committee Operations Committees. He was the Co-Editor-in-Chief of the Telecom Antitrust Handbook and is a member of the Board of Editors of Antitrust Report.

He received his Juris Doctorate from George Washington University Law School and his Bachelor of Arts from Georgetown University. Additionally, he served as a clerk for the Honorable Charles R. Richey on the United States District Court for the District of Columbia.
